SESSION FEES: SESSION FEES: Three milestone sessions (newborn, 6-7 months, 12 months; dates to be determined) total cost of $1800. Deposit of $600 due the date of booking with balance of $400 due on or before the date of each session. Your fee covers the on-location session time with the PHOTOGRAPHER, retouching and artistic editing of the images, as determined by the PHOTOGRAPHER, a gallery of the high resolution digital files, and (40) 5x7” prints of choice. REFUNDS/GIFT CERTIFICATES: Due to the custom nature of your portraits, all purchases are final and no refunds will be made. Gift certificates, special offers, and other credits are non-transferrable and are not redeemable for cash. WEATHER CONDITIONS: If, in the opinion of the PHOTOGRAPHER, inclement weather or other adverse conditions prevent the creation of a portrait meeting the artistic standards of the PHOTOGRAPHER, PHOTOGRAPHER may elect to use an alternate location or reschedule the portrait session. CANCELLATION POLICY: PHOTOGRAPHER reserves the right to reschedule due to illness, equipment malfunction, or other circumstances beyond her control. LIABILITY: The PHOTOGRAPHER is not responsible for any injuries incurred by the photographic parties. CLIENT will be responsible for their children and themselves, and release the PHOTOGRAPHER from any claims. DIGITAL FILES: Client will receive only the edited high resolution .jpg digital files from the session, a limited print release, and instructions on how to best print the high resolution files. An online gallery is sent via email to client with access to download the entire gallery within 14 days. Digital files are not to be edited or resold. PHOTOGRAPHER does not guarantee the quality of photographs printed at a non-professional lab. MODEL RELEASE: The PHOTOGRAPHER reserves the right to use images created under this contract for advertising, display, publication, or other purposes. The client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend the PHOTOGRAPHER in the event of litigation arising out of such use. Digital files and previews remain the exclusive property of the PHOTOGRAPHER. ARCHIVE: All images are archived one year after the session. The PHOTOGRAPHER is not responsible for loss or damage of digital files for circumstances out of her control. METHOD OF PAYMENT: Payment may be made in cash, check, or credit card (PayPal or via phone). TRAVEL: Travel time is included in the session fee unless over 30 miles. Session location will be agreed upon during booking and if location is farther than 30 miles, a travel free will be incurred. COOPERATION: CLIENT agrees to positive cooperation and communication for the best possible result within the definition of this assignment. PHOTOGRAPHER is not responsible for key individuals failure to be present or cooperative during the session. IMAGE PROCESSING: PHOTOGRAPHER reserves the right to edit and retouch images in a style and manner of their choosing. Basic processing is included in all packages. DIGITAL NEGATIVES, PRINTS, AND COPYRIGHTS: All photographic materials shall be exclusive property of the PHOTOGRAPHER. PHOTOGRAPHER shall own the copyright of all images created and have exclusive right to reproductions. PHOTOGRAPHER shall only make reproductions for the client, portfolio, samples, self promotions, entry in contest or exhibitions, editorial use, or display in studio. COMPLETION SCHEDULE: Client will receive digital files within 2-3 weeks from session date. All files will be received via digital download. USB will be included in Senior Sessions and Full Family Sessions.
